Budget resolution

A budget resolution is a concurrent resolution: it is agreed by both chambers but is not presented to the president and does not have the force of law. Its effect is internal to Congress. It sets aggregate spending and revenue targets and allocates them among committees, and those allocations then constrain what individual bills can do without triggering a point of order.

Its other function is procedural. If the resolution contains reconciliation instructions, it directs named committees to produce legislation meeting a fiscal target — and that legislation moves under expedited rules in the Senate.

A worked example

In April, both chambers agree a budget resolution setting total spending, revenue and deficit levels for the coming fiscal year and the nine after it. Nothing has been spent and no tax has changed: the President never sees it. But the resolution includes an instruction to the Finance Committee to report legislation reducing the deficit by a stated amount over ten years. That instruction is what makes a reconciliation bill possible that year.

If the two chambers pass different resolutions and never agree on one, or if neither passes one at all, the year proceeds without: appropriations still happen, but reconciliation is off the table and the aggregate targets have no enforcement.

How to read it in coverage

“The Senate passed a budget” usually means a budget resolution, not a law. Whether it matters depends almost entirely on whether it carries reconciliation instructions — a resolution without them is a statement of priorities that binds no one. And a resolution is often adopted months into the fiscal year it nominally governs, sometimes purely to unlock reconciliation, which is a sign of what its real function has become.
